Gallea aims to simplify the purchase process of local art by combining art and technology. Gallea is a network of art lovers, artists and urban exhibitors. By registering to Gallea’s platform, members agree to the following terms and conditions. In the case of non-compliance of the terms and conditions, Gallea reserves the right to bring exhibitions to an end without any refund of charges at any stage of the process.

    GALLEA’S EXHIBITORS AGREE TO:

  1. Reserve wall spaces listed on Gallea at no cost and only for works available on Gallea’s platform.
  2. Actively manage their profile by ensuring that all information, photos and availabilities of the reserved spaces are up to date.
  3. Sort and treat display requests from artists within 7 days when a Gallea’s wall space is empty except when:
    1. there is no artwork matching the atmosphere of the establishment among the requests according to the subjective opinion of the owner / manager
    2. the property is under renovation
    3. the establishment is temporarily closed for more than 2 weeks
  4. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Gallea.
  5. Confirm transactions when a purchase is made by calling one of Gallea’s managers (1-438-558-5821) with the transaction code that the client has received by email, then have them sign the confirmation of receipt in annex 1 before leaving with the painting. (The confirmation of receipt form must be kept by the institution.)
  6. Redirect customers wishing to buy or to learn about the works to the associated codes displayed on the Gallea.ca tags so they can buy directly with their credit card online.
  7. Go through Gallea for all communication with artists. In the aim to centralise communications for logistics, it is not permitted to contact Gallea artists in the context and the process of exhibitions with Gallea, apart from exceptions in which you have Gallea’s agreement. Once agreement has been given, this is only for the temporary use of this given situation and the exhibiting venue is not permitted to use the artist’s contact information temporarily provided for future personal or promotional ends.
  8. Provide the necessary equipment to prepare the walls for a safe display of the artwork on the walls (nails, screws, hammer, etc.). Otherwise, the exhibitor agrees to pay fees for wall hardware such as velcro Command Strips, nails, etc. provided by Gallea. (The artist is only responsible for the preparation for display of the artwork, with the iron wire installed behind the canvas.)
  9. Respect the artists’ work by prohibiting clients and staff from touching or moving the works except in the case of a post-sale, post-confirmation and post-signature transaction.
  10. Respect the initial agreed display placement of an artwork during the 3-month display period to avoid confusions concerning the Gallea reference codes. Fees of 50$ per artwork will be charged to the establishment for any change of location within the same business during the 3-month period. In the case of early cancellation of the display of an artwork by the establishment within the three-month contract, fees of 100$ per artwork removed will be charged to the business.
  11. Be courteous and friendly when interacting with Gallea’s artists and clients
  12. Inform Gallea of any changes related to the operations of the establishment that may influence the transactions and / or the agreement with Gallea such as the changes regarding business hours, owners / managers, contact information, website, etc.
  13. Contact and notify Gallea of any problem related to transactions and contacts with the artists and customers by email (info@gallea.ca) or by phone. All sales of the displayed artwork must be made through gallea.ca or will not be considered valid.
  14. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the artists they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Gallea accompanied by the name of the artist, the link to the Gallea exhibition, the link to the artwork’s Gallea page or the link to the artist’s Gallea profile are allowed.

    GALLEA ARTISTS AGREE TO:

  1. Actively manage their profile by ensuring that all information, photos and availability of their artwork on Gallea’s platform are accurate and up-to-date. The profile picture must show the artist and only the artist without indecent content. An image or photo representing another object than a portrait of the artist will not be accepted. Photos of artwork must be centered, cropped without background and with uniform brightness. The artist attests to be the author of the works in his/her profile and to own all the rights to distribute the content presented. Gallea reserves the right to remove the picture or to remove the visibility of a picture, image or profile that does not meet the criteria mentioned above. If an online displayed artwork is sold through Gallea but is no longer available at the moment of purchase, service charges and administration fees may be charged to the artist. Gallea reserves the right to hide or delete, without notice any content that Gallea judges as defamatory, obscene, pornographic, vulgar or offensive, presenting any degree or nature of discrimination, bigotry, racism, hatred, harassment, violence or harm against any individual or group, or promoting illegal or harmful activities, products or substances.
  2. Ensure the optimal realistic representativeness of their works on the platform. The owner or manager of the establishment can refuse a work if the quality, colours or dimensions do not faithfully reflect the work displayed on Gallea’s online platform. By uploading an artwork to Gallea, the artist confirms that he/she is the original author of the work and owns all rights to broadcast the content.
  3. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Gallea.
  4. Go through Gallea for all communication with exhibiting venues. In the aim to centralise communications for logistics, it is not permitted to contact exhibiting venues in the context and the process of exhibitions with Gallea, apart from exceptions in which you have Gallea’s agreement. Once agreement has been given, this is only for the temporary use of this given situation and the artist is not permitted to use the exhibiting venue’s contact information temporarily provided for future personal or promotional ends.
  5. Deliver their works within 7 days when assigned a Gallea establishment’s space. If this period is exceeded, the institution is entitled to allocate the space to another artist.
  6. Make sure that their artwork is ready for display, (wire installed, frame, etc.) when brought to the exhibitor.
  7. Redirect interested customers to the Gallea’s online platform.
  8. Respect the initial agreed display placement of an artwork during the 3-month display period to avoid confusions concerning the Gallea reference codes.
  9. Be courteous and friendly when interacting with institutions and clients.
  10. Respect the 3-months-posting agreement as any sale of physically displayed artwork during the 3 months in an establishment must be processed through Gallea’s platform. It is not possible to withdraw the work displayed by Gallea in establishment before the end of the 3 months’ period unless it is sold via Gallea.ca or unless the artist pays Gallea the 30% value of the displayed price of the artwork. A physically displayed artwork in a Gallea’s establishment is automatically available for sale for the entire three months’ period. In the case of a work displayed on the platform and not in an establishment, the artist may withdraw it at any time, unless the work is sold via the gallea.ca platform, in which case the artist will have the responsibility to make the work available to Gallea for delivery to the customer who made the purchase. It is not allowed to change the price of an artwork during the 3 months’ period.
  11. (Updates of terms and conditions during social distancing measures in relation with covid-19). To respect the means of delivery and deposit of artwork when a sale takes place on the platform. We will proceed with a case-by-case scenario for the delivery of artwork because of the social distancing measures relating to covid-19 to find the best option for you and best adapted to the situation.
    1. By post (sales between different cities or international): wrap up the artwork in bubble wrap according to the instructions we will give you according to the size of the artwork (bubble wrap, cardboard, personal message to the buyer etc.). Print and stick the delivery tag given by Gallea on the wrapped artwork and bring the artwork to the delivery intermediate such as Canada Post. (In case there is missing wrapping material or a printer for the delivery sticker, it is possible to deliver the artwork at a Gallea deposit spot* in Montréal or to organise a meeting to collect directly where you are based if you live in Montréal and its surroundings).
    2. By Gallea delivery (Montréal and surroundings): wrap up the artwork according to the instructions given to you (bubble wrap, cardboard, personal message to the buyer…). Gallea will organise a moment for you to drop off your artwork at one of the drop-off locations* or organise to pick-up the artwork directly from your location.
    3. By direct delivery (in the same city, outside Montréal): wrap up the artwork according to the instructions given when art sales take place (bubble wrap, cardboard, personal message to the buyer…). Gallea will organise a delivery moment between you and the buyer. You will be invited to deliver the artwork directly to the buyer and Gallea will cover your travel costs.

*Our deposit and pick-up points during the time of social distancing will be situated between the Sherbrooke metro station and Côte-des-Neiges station in Montreal.

  1. Respect the 30% Gallea and 70% free membership artist on sales on Gallea’s platform, 25% Gallea and 75% Premium membership artist on sales on Gallea’s platform, and 15% Gallea, 10% exhibitor and 75% Premium artist on sales of artwork on display in an establishment of Gallea’s network.
  2. Inform Gallea if he/she cannot ensure the in-time pick-up delivery or availability of an artwork. If an artwork is not picked-up by the artist within one week after the end of a contract, it will be stored at one of Gallea’s service points for the artist with applicable additional service fees.
  3. Be responsible for insuring their artwork, as the institutions are not held responsible for any damages, theft or loss.
  4. Contact and notify Gallea for any problem regarding transactions by email (info@gallea.ca) or by phone (1-438-558-5821), depending on the emergency of the situation
  5. Make sure to have the establishment sign the confirmation of receipt as proof of the deposit of their work for a physical display.

    BUYERS AND VISITORS OF THE PLATFORM GALLEA COMMIT TO:

  1. Proactively manage their profile by ensuring that all contact and billing information are accurate and up-to-date.
  2. Ensure optimal realistic representativeness of an artwork on the platform before buying. All purchases are final and non-refundable except if the purchased artwork is no longer available at the time of the transaction, case in which the total of the transaction will be refunded to the buyer.
  3. Take knowledge of the contents of the email, verbal or written notifications of changes to the terms and conditions informed by Gallea.
  4. Pick up the artwork within 7 days after a purchase is processed. If this period is exceeded, the work will be transported to one of Gallea’s service points.
  5. Respect the means of delivery or deposit requested during the purchase:
    1. By pickup in establishment: Show the confirmation code in person, wait for the code verification and sign the confirmation of receipt of before leaving with the artwork.The buyer is responsible of checking the availability of the establishment for the pick-up of the art work beforehand, by telephone or in person.
    2. By mail: No action required
    3. By pickup at one of the Gallea pickup points : Appear in person with the confirmation code or other means established by Gallea.
    1. Be responsible for a purchased work from the moment it is delivered to them or from the moment it is picked up in an establishment.
    2. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the artists they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Gallea accompanied by the name of the artist, the link to the Gallea exhibition, the link to the artwork’s Gallea page or the link to the artist’s Gallea profile are allowed.

    GALLEA COMMITS TO:

  1. Offer its best efforts to ensure a dynamic platform and a courteous and understanding service to its members.
  2. Inform members of changes regarding Gallea’s services and policies.
  3. Respect the agreement of 10% establishment, 20% Gallea and 70% artist of the price for the sale of a Gallea’s physically displayed artwork and the agreement of 30% Gallea and 70% artist of the price for the online-displayed-only sale of a displayed artwork.
  4. Offer its best efforts to ensure the respect of the means of delivery, shipping or deposit requested by the buyer when an artwork is sold on the platform or in an establishment. Alternative means of delivery or pickup will be suggested by Gallea otherwise.
  5. The artworks displayed on the platform or in an establishment are not to be reproduced in any format without the written consent of the artists they belong to except for the purpose of online, offline and through all other form of media promotion, where only the photographs of the works in its context background clearly visible or photo of the work uploaded on Gallea accompanied by the name of the artist, the link to the Gallea exhibition, the link to the artwork’s Gallea page or the link to the artist’s Gallea profile are allowed.
